By choosing to appeal, you agree to the following terms and conditions:

Legally Binding Contract: This agreement constitutes a legally
binding contract between Effective Arbitration, Inc (Company),
the Organization and the Consumer.

Appeal Initiation: A refundable deposit (as outlined below)
must be made to initiate an appeal.

Appeal Fee: The fee for adjudicating an appeal is $50.00 .

Appeal Fee Deposit: To initiate an appeal the Consumer
shall be required to make a $25 ACH deposit. Organization shall be required
to pay an equal $25 deposit. Prevailing party shall receive their deposit
back upon adjudication determination.

Appeal Outcome Scenarios:
- Accepted: If the appeal is accepted, Consumer will be
refunded the appeal deposit amount in full. Organization will be responsible
for payment of Appeal Fee in full, shall waive the originating invoice,
and shall cease and desist from pursuing payment of said invoice.
- Rejected: If the appeal is rejected, the deposit will be
retained from the Consumer, and the original amount of the invoice, in addition
to the $25 balance of the appeal fee, will be due and payable within 15 days.
Said balance will be deducted from the same ACH account provided during appeal initiation.
Consumer may change account details any time prior to the 15 days expiring.
- Reduced: An Adjudicator at their sole discretion may reduce or waive any fees due,
including appeal fees. If the appeal results in a reduction, deposits as well as original amount
due will be split as directed by Adjudicator.
Any remaining amount due from either Organization or Consumer will be due and payable within 15 days.
Balances will be deducted from the same ACH account provided during appeal initiation.
Consumer may change account details any time prior to the 15 days expiring.

Response Time: In the event that an appeal has been initiated,
both parties are expected to respond to Adjudicator requests within 7 days,
or as may otherwise be set by state statute.
Failure to respond may result in the appeal being decided against the non-responsive party.
Adjudicator may waive or extend timelines at their sole discretion.

Payment Method: Payment for appeal cases is only accepted from a bank account via E-Check (ACH).
Credit cards are not accepted as a valid form of payment.
- Informality and Waiver of Formal Procedures:
The parties acknowledge and agree that any appeal provided under this Agreement is strictly informal in nature.
All parties expressly waive any requirement for formal procedures, including but not limited to rules of evidence,
formal hearings, written submissions in specified formats, or adherence to statutory or judicial appeal standards.
The appeal process shall be conducted in a manner determined at the sole discretion of the Adjudicator,
and the parties agree that such informal process shall be final and binding to the extent permitted by law.

Acceptance Requirement: By accessing the arbitration services provided by the Company,
you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
